Rent law | Bracke Advocatuur, Law firm The Hague

What exactly are the obligations of the tenant and the landlord? In practice, both tenants and landlords do not exactly know what their rights and obligations are to each other.

Dutch law provides a number of mandatory provisions on how a tenant and a landlord in certain situations should be acting. The legislation, however, partly exists of regulatory law which makes it for tenants and landlords often difficult to estimate their legal position.
Often problems arise around notice periods, rent payments, the determination of the contract, maintenance defects, disruption of the rental or enjoyment by (co) tenants etc.
